    Definitions
  1. By using our services, you are agreeing to be bound by these Terms and Conditions and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law. In these Terms of Service (TOS) the customer will be referred to as 'you', whereas BuxHost will be referred to as 'we'.
    Disclaimer
  1. The materials on BuxHost's web site are provided "as is". BuxHost makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, BuxHost does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.
    Limitatation of liabilities
  1. In no event shall BuxHost be liable for any damages (including, but not limited to, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the services and materials of BuxHost, even if BuxHost or an authorized representative has been notified orally or in writing of the possibility of such damage. We refrain from any responsibility towards the end-users or members of our customer's websites, including third party scripts like the forum.
    NextGen PTC Script, hosting and domains
  1. The NextGen PTC script remains property of BuxHost.com. To protect our intellectual property rights you are not able to view or edit the script source. As a consequence, no FTP or cPanel access to your hosting package is provided. All modifications can be made in the Admin Panel of the script.
  2. Updates for the script are free of charge and installed automatically. All updates are mandatory, as they may include security fixes.
  3. Yearly startups have to be extended 20 days before the subscriptions ends. If not, the subscription will automatically end after that year.
  4. Support for the free phpBB forum (third party application) is not provided by BuxHost, but by phpBB. Forum updates and addons/themes are not offered. Some forum features are disabled, among which are the search function and sending out email from the forum. It's your responsibility to keep your forum free of spam. Forums containing a large number of spam posts are considered abandoned and will be removed.
  5. Although we're making an effort to keep hosting performance at high levels, the quality of hosting can not be guaranteed.
  6. Bandwidth is calculated per calendar month. Additional bandwidth expires at the first day of each calendar month.
  7. Domains cannot be transferred to third party registrars. Domains are automatically canceled 45 days after cancelling your account. DNS access is restricted.
  8. It's the customer's responsibility not to use domain names infringing trade mark rights. If a trademark infringement has been detected, the domain will be removed without the right for a refund.
  9. It's the customer's responsibility to provide accurate WHOIS contact details upon submitting the order.
    Refund policy, disputes and charge backs
  1. Paid fees and/or invoices are not refundable.
  2. Any payment investigation, reversal, dispute or charge back will lead to a temporary account suspension until the case has been resolved.
    Affiliates
  1. The intention of the affiliate program is to attract new potential customers, i.e. individuals. For that reason it is not allowed to sign up to (or help someone to sign up to) our services using your own affiliate URL. If you do, you balance is voided.
    Account Termination
  1. Subscriptions can be canceled at any moment. Note that paid fees are non-refundable.
  2. Expired or canceled websites can be revoked from permanent termination within 7 days after being expired or canceled, provided this is technically possible.
  3. A license can be renewed within 7 days after it has expired. Even when renewed after its expiration date, the renewal fee will cover the period starting from the last expiration date.
  4. Although we do not intent to, we remain the right to temporarily suspend or, in severe cases, terminate your account(s). Valid reasons are, but not limited to, spamming, displaying inappropriate/adult content, payment disputes/reversals/investigations, misuse of the system or identity theft.
    Terms of Service modifications
  1. BuxHost may revise these terms at any time without notice. By using our services you are agreeing to be bound by the then current version of these terms and conditions.
